Terms & Conditions 2018

This ticket is sold by Complete Events Group (ABN 81 609 796 198) who is the authorised promoter for the Event. The following conditions are both of *sale *(including any resale or subsequent assignment), * entry *and *attendance* at the Event.

Who you are buying from

1) 'You' and 'your' refers to the customer. 'We', 'us', 'our', 'ANTHEMS', ''Presenter' and 'Event organiser' refers to Complete Events Group, its employees, contractors, volunteers and authorized persons. This agreement means these terms and conditions and any other conditions specified by us on our website and booking forms.

2) If the name is listed at 1. above is OZTIX then this web site and the web site oztix.com.au (the "Oztix Website") are owned and operated by Ticket Solutions Pty Ltd (ACN 106907206) t/as Oztix of PO Box 476, Annerley, 4103, Queensland, Australia ( 'We', 'Our' or 'Us') and We operate the ticketing services offered via this website as the authorised agent of event organisers, such as artists, venues or event promoters ('Presenter') and any tickets purchased from this website are purchased from Us as the agent of the Presenter. Any dispute you have relating to an event or ticket purchase is between you and the Presenter. As agent for the Presenter, We are not liable for any claims relating to an event or ticket purchase, except as otherwise set out in these terms and conditions.

What you are agreeing to

1) By visiting, using or purchasing any tickets via this website you agree to be bound by these Terms and Conditions and Our Privacy Policy.

2) Every ticket sold through this website is also subject to:

a) the Presenter's additional event term and conditions (please see the Presenter's website);

b) any terms and conditions of the venue at which event is held (please see the venue's website); and

c) any terms and conditions that may be printed on the ticket.

Use of this Web Site

1) Use of this website is restricted to personal use and reference only.

Conditions of Sale

1) All Prices quoted are in Australian Dollars and include local taxes (GST).

2) Online sales will cease when the allocation of tickets is sold, at a time otherwise specified or usually 2 hours before doors open for the event.

3) The Presenter reserves the right not to sell tickets to any person, agent or company.

4) Tickets will be delivered to you by the method you select during the booking process. If tickets are sent using Registered Post or a Courier service they will only be sent to addresses where the purchaser can sign for delivery. Mail delivery option will cease to be offered 7~10 days before the event.

5) Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder.

6) Not withstanding these terms and conditions, if You use a "disposable" or "temporary" credit card (such as those purchased over the counter at supermarkets) for Your online purchase We are not able to make any refund to you unless a) you can provide full details of the credit card; b) the credit card remains valid; and c) you can produce the online purchase receipt.

7) Note: your Credit Card statement will itemise a purchase as a charge from " Complete Events Group."

Ticketing

1) The Presenter will only refund tickets in accordance with these terms and conditions and to the extent permitted by law. The Presenter or Oztix has no liability to you.

2) All bookings and ticket purchases are *non-transferable* and may not be sold or transferred by you. Conditions Apply.

3) *NO REFUND OR EXCHANGE ON ANY TICKET* or service fee will be given. This is an all-weather event. No refunds will be made if you choose not to attend due to inclement weather.

4) If We authorise a Refund, We will refund to you the Ticket Price, the Booking Fee, the Processing Surcharge and if applicable any Delivery fees charged for and tickets were not dispatched.

5) Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.

6) We reserve the right to charge a fee for the replacement of lost, destroyed or stolen tickets. Please treat your ticket as you would money or other valuables.

7) There will be *no refund* on any unused portion of tickets if you or your invitees are asked or forced to leave or if you decide not to attend any part of the Event. 

8) If you purchase a transport ticket, it is your responsibility to board the chartered bus at its described pickup and drop-off locations. ANTHEMS holds no responsibility should you miss your designated transport option. No refunds available.

Artists and Venue

1) We reserve the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.

2) If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.

3) We reserve the right to cancel or postpone the Event for any reason. In the event of the cancellation in advance of the Event, we will provide a refund less an amount to cover the cost of ticketing and already paid production & artist fees.

4) We reserve the right at any time, to change the venue of the Event. In the event of a change in venue, we will publish any relevant information regarding any cancelled or rescheduled events on the ANTHEMS website when applicable. It is your responsibility to check our website for information in relation to any events.

Conditions Of Entry

Prohibited Items on Entry

Entry

1) The right of admission is reserved and is subject to the Event organiser and the venue's terms of admission, copies of which are available online and from ANTHEMS on request.

2) Wristbands will be attached at the gate and must be worn at all times for the duration of the Event.

3) If entering the Event as an adult, ID to prove legal age must be shown at the Festival entrance, if required or on demand.

4) It may be a condition of entry to the Event that a search of your person and/or your possessions and motor vehicles is required at the time of entry to the venue. GLASS, ALCOHOL, WEAPONS, ILLEGAL SUBSTANCES or any item the Event organizers consider may be used in an illegal or offensive manner may be confiscated. Refusal to consent to a search WILL prevent entry to the Event, without refund.

5) Entry may be refused if tickets are damaged or defaced in any way or are not purchased through an authorized point of sale. Do not share your ticket barcode, it may prevent entry.

Audio and Visual

1) Audio or visual recordings of the Event are prohibited. Still cameras are permitted but images may only be used for private purposes and not public display. By attending the Event, you consent to being included in any film and/or sound recordings of the Event that may take place and agree for these recordings to be used by the Event organiser.

Liability

1) To the fullest extent permitted by law, we do not accept liability of any nature for the acts, omissions or default of those providing services in connection with the Event or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with this Event. Where legislation implies any condition or warranty which cannot be excluded or modified, that condition or warranty will be deemed to be included in this agreement. However, our liability for any breach of such condition or warranty will be limited, at our option, to the resupply of the services or the cost of having the services supplied again. In no event will we be liable for any indirect, consequential, exemplary or special damages.

2) Admission is at the ticket holders own risk. You acknowledge that neither we nor the venue will be responsible for any loss or damage to property (including personal property such as bags, money or other personal items) brought to or purchased at the Event by you or your invitees.

3) You will be liable for any loss or damage caused at the Event by you or your invitees.

Conduct

1) You must ensure that you and your invitees act in an orderly manner when attending the Event. We may refuse entry or evict you or any of your invitees if they are behaving in an intoxicated, disorderly, offensive, threatening or inappropriate manner, towards any person.

Alcohol, smoking, illegal substances and Glass

1) The whole venue, outside of the designated VIP area, is a *GLASS FREE ZONE* and no glass shall be brought into any part of the venue including the car parks. Please do not bring glass into the Event, broken glass and festivals do not mix, consider your fellow humans feet.

2) *THE FESTIVAL EVENT AREA IS LICENSED. *Any patron wishing to consume alcohol must have photographic ID. We reserve the right to evict patrons who disobey or break Responsible Service of alcohol legislation and the law.

3) Anyone found supplying or buying alcohol for a minor will be evicted from the Event and handed across to the Police to face criminal charges.

4) Anyone found supplying or consuming illicit drugs will be evicted from the premises and handed across to the Police to face criminal charges.

5) Certain areas within the Event venue may be smoke free zones. Smoking will not be permitted within any area other than the designated smoking areas.

6) Sealed plastic water bottles are permitted to be brought into the Event. The contents of any opened plastic water bottles will not be permitted into the venue.

Trading

1) Trading signs or other signs are not permitted without prior consent of ANTHEMS. No ticket holder shall be entitled to do any trading without the written consent of the Event organizers.

2) Tickets cannot be used as part of any marketing, media or sales promotion whether commercial or non-commercial without prior written consent of the Event organizers.

General

1) Footwear must be worn at all times on the site.

2) Animals are not permitted, except in accordance with legislation.

3) This agreement is governed by the laws of ACT, Australia.

4) Some ticket types may require adherence to specific guidelines that are published on the Event website from time to time. You must ensure that you meet such guidelines.

5) Any breach of any of these terms and conditions will entitle the Event organizers to evict the ticket holder from the venue and confiscate any ticket or wristband, without refund.

Environment and Community

1) The organiser cares for the environment and community. Please be respectful and place any litter in the recycle or other bins provided around the venue. Be waste and water wise - thank you.
38. Please respect our town and neighbours and do not create excessive noise or litter while travelling to and from the Event.

Changes to Terms and Conditions

1) The terms and conditions that apply to any particular transaction will be the published terms and conditions at the time the transaction was finalised. Subject to the preceding sentence, We may alter or change the terms and conditions as they appear on our website from time to time effective immediately from posting on the web site.

2) You should periodically check this page of the web site to ensure that you are aware of the latest terms and conditions.

What happens if you have an inquiry or complaint?

1) For inquiries or complaints regarding the sale and delivery of tickets please contact us by email c/o info@oztix.com.au or telephone 1300 762 545.

2) For inquiries or complaints regarding the staff and / or amenities at a venue or event, please contact the venue management.

3) For inquiries or complaints regarding the artist's performance, sound or lighting or production quality, please contact the Presenter.

Data, Privacy and Security

1) When We process your order We collect your credit card and may keep personal information about you including your name, address, telephone number and the names of all ticket allocations in accordance with Our Terms and Conditions, our Privacy Policy and our Privacy Collection Notice. We may also need to disclose your personal information as required by law or as permitted under the Privacy Act.

2) If you are concerned about using your credit card online please contact us for assistance.

3) If you deny or dispute a charge on your credit card made by us, please contact us immediately. We consider credit card fraud to be a serious offence and we aim to prosecute each case to the fullest extent possible.

Copyright and Trademark

1) The images, text, logos and artwork contained within this site are copyright to Presenter, Oztix and/or the relevant licensors. All rights are reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise transmitting in any form or by any means in whole or in part is prohibited. The Oztix logo is a registered trademark.

Disclaimer and liability

1) You accept that the Internet is not always a reliable and that system outages may occur.

2) Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, We or Oztix will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your purchase of any tickets or your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not We know of the possibility of such damage.

Choice of Law

1) These Terms and Conditions shall be governed by the laws of the State of Queensland, Australia but legal proceedings may be commenced in any Australian State or Territory.

Australian Consumer Law

1) Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties which we provide under this Agreement. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
